1. Agreement to Terms

Welcome to Simsime Travels & Tours Pvt. Ltd. ("Simsime", "we", "us", or "our"). By accessing or utilizing our website (simsimetravels.com), booking flight tickets, inquiring about tour or trekking itineraries, or utilizing our administrative editorial portal, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

Simsime Travels & Tours is a legally registered travel and trekking company under the Government of Nepal (Department of Tourism, Ministry of Culture, Tourism and Civil Aviation) and an active member of the Nepal Association of Tour & Travel Agents (NATTA Member ID: 778/19).

2. Services Provided

Simsime Travels provides comprehensive travel facilitation services across Nepal and international destinations, including:

Flight Reservations & Ticketing: Domestic mountain and intercity flights across Nepal, as well as worldwide international airline tickets.
Expeditions & Trekking: Guided mountain treks across the Everest, Annapurna, Langtang, and Manaslu conservation regions.
Cultural & Wildlife Tours: Heritage circuits throughout Kathmandu Valley, Lumbini pilgrimages, and Chitwan/Bardia jungle safaris.
Documentation & Permits: Procurement of mandatory National Park permits, TIMS cards, and visa facilitation guidance.

3. Booking, Payment & Confirmation

Inquiry & Quotation: Inquiries made via our concierge modal or forms do not constitute a confirmed reservation until availability is verified and confirmed by our travel desk.
Ticketing Issuance: Domestic and international flight tickets require full payment and verified passport details prior to final ticket issuance according to International Air Transport Association (IATA) and carrier standards.
Trekking Deposits: Fixed-departure or customized trekking itineraries require an initial deposit to secure permits, domestic logistics, and certified Sherpa mountain guides.

4. Cancellation, Amendments & Refunds

Airline Tickets: Cancellations, date changes, and refund amounts are governed strictly by the issuing airline's fare rules and cancellation penalty matrices. Promotional or economy non-refundable tickets cannot be refunded.
Government Permits: National Park, Conservation Area (ACAP/MCAP), and TIMS permit fees are non-refundable once issued by government counters under Nepali tourism regulations.
Weather Contingencies: Mountain flights in Nepal (notably flights to Lukla / Tenzing-Hillary Airport, Jomsom, and Phaplu) are subject to weather conditions. In the event of flight delays or cancellations due to inclement weather, Simsime coordinates rescheduled departures or helicopter charter alternatives subject to prevailing operator fees.

5. Mandatory Travel & High-Altitude Insurance

Essential Requirement for Himalayan Treks: All travelers embarking on trekking or expedition programs in Nepal must carry comprehensive travel insurance explicitly covering high-altitude emergency helicopter evacuation (up to 5,500m+) and medical treatment. Proof of valid insurance must be presented prior to trek departure.

6. Application Terms & Editorial Portal Acceptable Use

Simsime Travels operates a protected editorial and blog publishing platform at /blog-dashboard/ for authorized personnel only:

Authorized Access Only: Access is restricted strictly to verified administrative personnel (prem.simsime@gmail.com and joshishabdikraj@gmail.com) authenticated via Google OAuth 2.0.
Account Security: You may not share credentials, attempt unauthorized bypass of security perimeters, execute automated scraping, or introduce malicious payloads.
Rate Limiting & Lockout: Any device exceeding 3 failed login attempts within a 15-minute window is automatically blocked. Repeated malicious behavior will result in permanent IP blacklisting and reporting to regulatory cyber defense authorities.
Intellectual Property: All editorial content, photographs, trip descriptions, and branding elements published on the website remain the exclusive intellectual property of Simsime Travels & Tours Pvt. Ltd.

7. Limitation of Liability & Force Majeure

Simsime Travels coordinates with accredited airlines, hotels, transport providers, and mountain guides. While we exercise the highest professional diligence:

We are not liable for delays, damages, cancellations, or losses arising from events beyond our reasonable control (Force Majeure), including adverse Himalayan weather, landslides, flight cancellations, geopolitical unrest, or public health emergencies.
Travelers are responsible for verifying valid passport validity (minimum 6 months from entry date), visas, and health immunizations.

8. Governing Law & Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the Federal Democratic Republic of Nepal. Any legal disputes arising out of or in connection with our services shall be subject to the exclusive jurisdiction of the competent courts in Kathmandu, Nepal.
